These Terms of Service (“Terms”) govern your use of the Alcophone mobile application (“App”) published by its developer (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 21 years of age (the legal drinking age in the United States) to use Alcophone. By using the App, you confirm that you meet this age requirement. We reserve the right to terminate access for any user who does not meet this criterion.

2. Nature of the App — Important Disclaimer

• BAC estimates may differ significantly from your actual blood alcohol level due to individual biological variation, medication, food intake, hydration, and other factors.
• You must never drive or operate machinery after consuming alcohol, regardless of what any app, calculator, or estimate indicates.
• Alcophone is not a medical device, diagnostic tool, or breathalyzer replacement.
• The developer is not responsible for any decisions you make based on information displayed in the App.

3. Acceptable Use

You agree to use Alcophone only for its intended purpose: personal, informational tracking of alcohol consumption. You may not:

• Use BAC estimates as the sole basis for deciding whether to drive or perform any activity requiring sobriety.
• Reverse-engineer, decompile, or disassemble the App or its algorithms.
• Attempt to circumvent trial eligibility restrictions, purchase verification, or any other technical protection measures.
• Use the App for any unlawful purpose.

4. Free & Premium Tiers

Free Tier

The free version of Alcophone provides core BAC estimation features. Free users will see advertisements (banner ads and occasional interstitial ads) served by Google AdMob. Ad display is subject to Google’s ad serving policies.

Premium Unlock

• Type: One-time, non-consumable in-app purchase.
• Price: As displayed on the Google Play Store at the time of purchase.
• No subscription: There are no recurring charges. You pay once and retain Premium access indefinitely.
• Payment: All transactions are processed by the Google Play Store.
• Restoration: If you reinstall the App or switch devices, you can restore your purchase through the Google Play Store at no additional cost.

Free Trial

• A 14-day free trial of Premium features may be available to eligible users.
• Trial eligibility is limited to one trial per user. We employ technical measures, including server-side validation, to enforce this policy.
• The trial ends automatically after 14 days. No payment is required, and no charges are applied when the trial expires.

5. Advertisements

The free version of Alcophone displays advertisements provided by Google AdMob. Before ads are served, you may be presented with a consent prompt in accordance with applicable regulations. Ad-related data collection by Google is subject to Google’s Privacy Policy. Premium users do not see ads.

6. Intellectual Property

All content, code, designs, trademarks, and algorithms within Alcophone are the property of the developer or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we handle your data. Key points:

• All personal and health data is stored locally on your device.
• Anonymous analytics and crash reporting can be opted out of in Settings.
• Server-side trial validation uses an anonymous identifier only — no personal information is transmitted.

8. Data Deletion

You can erase all locally stored data at any time via Settings > Privacy & Legal > Erase All Data. Uninstalling the App also removes all local data. For more details, see our Data Deletion page.

9. Notifications

Alcophone may send local push notifications (BAC alerts, sober notifications, session summaries, hydration reminders, trial reminders). All notifications are generated on your device — we do not send server-based push notifications. You can enable or disable each notification category individually in the App’s settings, or disable notifications entirely through your device settings.

10. Limitation of Liability

• The developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
• We do not guarantee that BAC estimates will be accurate, reliable, or suitable for any particular purpose.
• In no event shall our total liability exceed the amount you paid for the App (if any).
• Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless the developer and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the App or violation of these Terms.

12. Third-Party Services

Alcophone integrates with third-party services including Google AdMob, Firebase Analytics, Firebase Crashlytics, and Google Play Billing. Your use of these services is subject to their respective terms and privacy policies. Alcophone also provides links to third-party rideshare applications for your convenience. We are not responsible for the availability, accuracy, or content of any third-party services.

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the App after changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the appropriate courts within the United States.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
